These Terms of Service ("Terms") constitute a legally binding agreement between HarkX Technologies Global Private Limited and you. By accessing our website, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our website you signify your absolute and unconditional consent to these Terms. If you do not agree, please discontinue immediately.

2. Definitions

  • "Customer," "User," "You", "Data Principal": the individual or entity engaging with HarkX Technologies Global Private Limited.

3. Eligibility

In accordance with the Digital Personal Data Protection Act, 2023, a "Child" is defined as any individual who has not completed the age of eighteen (18) years. We do not knowingly process the personal data of a Child without obtaining Verifiable Parental Consent (VPC) from a parent or lawful guardian.

5. User Accounts & Security

  • You are responsible for maintaining the confidentiality of your login credentials.

6. Intellectual Property Rights

All materials on this Platform, including but not limited to text, software, source code, scripts, graphics, photos, sounds, music, videos, interactive features, and "look and feel" (collectively, "Proprietary Content"), as well as the trademarks, service marks, and logos contained therein ("Marks"), are owned by or licensed to HarkX Technologies Global Private Limited.

7. Prohibited Activities

You represent and warrant that your use of the Platform shall comply with all applicable local, state, national, and international laws and regulations. You are strictly prohibited from using the Platform for any "Unlawful Purpose," including but not limited to activities that constitute a criminal offense, give rise to civil liability, or otherwise violate any prevailing Indian law, including the Bharatiya Nyaya Sanhita (BNS) and the Information Technology Act, 2000.

8. Limitation of Liability

To the maximum extent permitted by law, HarkX Technologies Global Private Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of the website. The website is provided on an "As-Is" and "As-Available" basis.

9. Termination

We reserve the right to terminate your access to the website without prior notice if we believe you have breached these Terms or if required by law.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Karnataka, India.

11. Force Majeure

HarkX Technologies Global Private Limited shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from an "Event of Force Majeure." This is defined as any event or circumstance beyond the reasonable control of the affected Party, which is unforeseeable, unavoidable, and not caused by the negligence of such Party.

12. Severability

If any provision, or portion thereof, of these Terms is found by a court of competent jurisdiction or an administrative body (such as the Data Protection Board of India) to be invalid, illegal, or unenforceable under prevailing statutes or public policy, such determination shall not affect the validity, legality, or enforceability of the remaining provisions of these Terms.

Upon such a finding of invalidity or unenforceability, the offending provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable, while preserving the original economic and legal intent of the Parties to the maximum extent possible.

If a provision cannot be so modified, it shall be severed from these Terms, and the remainder of the Agreement shall be construed and enforced as if such invalid or unenforceable provision had never been incorporated herein, provided that the essential purpose of the Agreement remains intact.
